Baila Bali is committed to providing a Tour and experience of the

highest quality. In the event that you are not satisfied with your Tour or service,

this refund policy explains when a refund is applicable.

You are entitled to cancel your participation in the Tour and ask for a refund:

• If you give notice (in writing) before the commencement of the Tour, as per the allowed schedule in the T&Cs.

• if the organisers of Baila Bali cancel the tour for any reason at their discretion.

You are not entitled to a refund if you:

• Simply change your mind outside of the allowed schedule in the T&Cs

• Are responsible for or involved in a situation causing you to terminate your participation outside of the allowed schedule in the T&Cs

Please note:

• Cancellations are to be made in writing by the Participant.

• Notice of cancellation is deemed to occur when received by Baila Bali.

• You may leave the Tour at any time by giving notice to Baila Bali.

You shall not be entitled to a refund and Baila Bali will not be liable for

any loss or damage you incur as a consequence of your leaving the Tour.

• You agree that you shall not make a claim against Baila Bali for any other loss suffered by you due to your cancellation.

• No refund shall be given for any portions of the Tour unused by the Participant after commencement of the Tour for any reason whatsoever.

• Refunds shall only be given to the Participant that made the booking and payment.

• You may join the tour later or leave the tour earlier, however you acknowledge that you will still have to pay the full amount of the Tour package.

• In the event that the balance of the payment plan is not paid in accordance with the payment plan set out, and Baila Bali, at its discretion, determines not to cancel the Participant’s booking, then the Participant agrees to pay to Baila Bali, any additional charges, fees or expenses that have been or may be properly incurred as a result of the balance of the payment plan not having been paid by the stipulated time.

Cancellation Made: Cancellation Fee – If you have paid a deposit/Full payment and you cancel between these time periods:

After Tour Commencement Date: 0% refund of Tour Cost

30 days prior to tour start: 0% refund of Tour Cost

31-60 days prior to tour start: 50% of Tour Cost


61 days or more prior to tour start: 75% of Tour Cost

Definitions



“Participation” means my involvement in all or part of the sponsored activities of the Tour,
including but not limited to: transport, dance classes, sightseeing and group social
activities, and other organised or ad hoc group activities of the Tour.
“Participant” means a person involved in “Participation”.
“Tour” means Baila Bali in any of the packages.

Voluntary Participation


I understand and confirm that my Participation in any of the Baila Bali is voluntary. I am in good health and suffer from no physical or mental condition that
would make me especially susceptible to injury or disability while participating in the Tour.

Warning and Acceptance of Risk
I understand that Participation in Tour activities could involve risk of physical injury, illness,
death or property loss, and despite safety precautions, TSF cannot
guarantee safety thereof, as all risks cannot be prevented. I understand that the Tour takes
place in public venues under conditions largely beyond TSF’s control.
I assume all risks, known and unknown, foreseeable and unforeseeable, in any way
connected with my Participation in the Tour. I accept personal responsibility for any
liability, injury, loss, or damage in any way connected with my Participation in the Tour, to
the extent permitted by the laws of the relevant jurisdiction. I accept that it is the
responsibility of the Participant to be informed about any travel advisories or warnings
issued by any Government Department.

Travel Insurance
 TSF does not provide travel insurance for trip Participants, and I understand
that any medical expenses, property loss, or other personal expenditures that result during
or from this travel/trip, are to be borne by the Participant.
I acknowledge that I have sole responsibility for my personal possessions and belongings
during the Tour. I acknowledge that it is a condition of Participation in the Tour to hold
travel insurance, and to that extent I hold appropriate and valid travel insurance for the
Tour. We also recommend that any Travel Insurance held by the Participant include
cancellation insurance.



I hereby consent and give authorisation to TSF to secure any emergency
evacuation or transportation, first aid and/or medical treatment in event that I am unable
to; and I agree to be responsible for all costs thereof.
This consent does not impose a duty upon TSF to provide any or all such
assistance, transportation, or services.

Tour Termination
I agree that TSF, acting reasonably, have the right to terminate or amend
the Tour, or any component thereof (including itinerary and activities), at any time for
whatever reason it sees fit at the time; and that in doing so, no liability to any Participant
shall arise (including any compensation).
 TSF, acting reasonably, reserve the right to terminate a Participant’s
involvement in any or all activities of the Tour, without financial compensation to such
Participant.

Compliance with Lawful Instructions
I agree to comply with all lawful instructions and directions of TSF, its
directors, employees, contractors, and volunteers during the Tour. I agree to not partake
in any drug/substance abuse during the Tour.

Promotional Release
I hereby grant TSF the unrestricted right and permission to use photographic
portraits, pictures, video footage and/or audio recordings of my Participation in the Tours,
in which I may be included intact or in part. TSF have the right to reproduce,
exhibit, distribute, broadcast, digitise, edit, or otherwise use the material, by any method
and in any media, as it deems appropriate.

Data Protection
 TSF will use its best endeavors to protect the Participant’s personal
information. However, the Participant acknowledges that TSF will, in order
to provide the services or products in question, need to provide some or all of the
Participant’s personal information to third parties, including overseas tour suppliers. The
Participant accepts all risk associated with the disclosure of the Participant’s data.


Release of Liability
‘I agree to absolve TSF, its directors, employees, contractors, and volunteers
from all liability however occurring from injury, death, loss or damage however caused,
arising from my
Participation in the Tour, together with any costs including legal fees that may be incurred
as a result of such claim (whether valid or not).The location where tours are conducted
may result in services, amenities and facilities being of a lower standard than the standard
to which a Participant is accustomed. The tours or parts of them are supplied or
undertaken by third party operators. Whilst TSF has undertaken due
diligence on the quality of the services offered by such third party operators, and has
been satisfied as to the adequacy of that quality, it cannot be responsible for any acts or
omissions on their parts.


The Participant also acknowledges that there may be flight/bus/train delays (due to
circumstances beyond the control of TSF) that may lead to interference with
a tour for which the Participant has booked. TSF will not be responsible for
any transport delays or loss of transport connections whether such loss is caused by the
Participant, TSF, any of its suppliers, an airline or other. In the case of any loss
of flight connections, whilst every effort will be made by TSF to continue with
the booked tour, TSF will not be liable to compensate Participants for any
lost part of their itinerary and will not be liable to pay for any additional costs that may be
incurred by the Participants as a result of any loss.
 TSF strongly recommends that Participants have insurance that will cover
them for flight cancellations and delays.’

Indemnity
I agree to indemnify and hold indemnified TSF with respect to any actions,
suits, proceedings, claims, demands, losses, damages, costs, penalties, fines, whatsoever
arising as a result, directly or indirectly, of my Participation in (and conduct on) the Tour.



THIS IS A WAIVER AND RELEASE OF LIABILITY. I HAVE READ, UNDERSTOOD AND ACKNOWLEDGE AND
AGREE TO THE ABOVE WARNINGS, REFUND POLICY, RELEASE OF LIABILITY AND INDEMNITY. BY
CONTINUING TO PARTICIPATE IN THE TOUR, I AM INDICATING MY VOLUNTARY AGREEMENT TO THE
PROVISIONS OF THIS WAIVER AND RELEASE OF LIABILITY, TO THE EXTENT PERMITTED BY THE LAWS OF
THE RELEVANT JURISDICTION.



This will be agreed upon when you complete the BOOK NOW form (by selecting that you agree to
the terms and conditions stated in this document) and confirm your spot on the tour with your first
payment deposit or full payment.
